Gwinnett Clerk Record Duties

The Clerk of Court handles a broad mix of records and fees. Duties listed for the office include deed and property recording, transfer tax and intangible tax collection, UCC recording, lien recording, plat recording, soldiers discharge recording, civil and domestic court filing, criminal court filing, arrest warrant filing, family violence filing, garnishment filing, adoption filing, appeals filing, notary certificates, trade name registration, fine and fee collection, court registry management, court technology, and Board of Equalization work.

  • Court files: Superior, State, Magistrate, and Juvenile court records served by the unified clerk.
  • Land records: Deeds, plats, condominium floor plans, UCC filings, liens, indexes, and images.
  • Domestic and family filings: Divorce, family violence, adoption, and related Superior Court filings.
  • Criminal filings: Criminal case processing, arrest warrant filing, appeals, fines, and court costs.
  • Business and public filings: Trade names, notary public certificates, partnerships, military discharge filings, and selected professional records.

Clerk staff can retrieve, certify, file, and index records. They cannot practice law. The office may provide more latitude in Magistrate Court and family violence matters, but clerk help should not be treated as legal advice about what to file, how to argue, or whether a court will grant relief.

Request Gwinnett Certified Copies

A certified copy is a clerk-issued copy that carries certification for official use. Certified copies may be needed for court, real estate, business, immigration, name-change, benefits, or appeal purposes. Plain online images are useful for review, but they may not satisfy a legal requirement for a certified copy.

  1. Identify the record type. Use court case search for case files, GSCCCA for land records, and the Probate Court process for marriage certificates.
  2. Gather the best identifiers. Include case number, party names, document type, recording reference, filing date, or book and page when known.
  3. Contact the correct counter. Use 75 Langley Drive or call 770-822-8100 for Clerk-served court and land records.
  4. Confirm fees before mailing payment. Land-record copy and certification fees are listed online, while some court-copy fees should be confirmed with the clerk.
  5. Request certified handling. State that the copy must be certified and ask whether pickup, mail, or portal delivery is available for that record.

Gwinnett Clerk Request Fields

The research did not capture one universal Clerk request form for all record types, so the safest request-field inventory is based on the identifiers the clerk and portals use. Court records need case and party data. Land records need recording and document data. Certified copies need the number of copies and mailing or pickup instructions.

Gwinnett Clerk Land Records

Gwinnett land records are a major Clerk record category. The Superior Court Clerk records deeds, plats, condominium floor plans, UCC filings, GED and lien filings, military discharges, partnerships, and physician licenses, and provides indexes and document images. The land-record history has an important boundary: Gwinnett's land records date back to September 26, 1871 because former records were lost in a fire.

The deeds and land records page is the official source for the Clerk's land-record scope.

This source is important for title and old-record searches because it explains the September 26, 1871 start point caused by the earlier fire loss.

The county open-records page says Superior, State, and Magistrate Clerk court records are not available through the county GovQA portal.

Effective August 1, 2019, central filing UCC documents are accepted only by electronic filing through GSCCCA. Effective January 1, 2017, plats, maps, and plans must also be electronically filed through GSCCCA.

Gwinnett Property Filing Alerts

Gwinnett County property owners can use the GSCCCA Filing Activity Notification System, often called FANS, for free opt-in alerts. FANS can send email or text notice when filings match the registered name or property criteria, but it does not send copies of recorded documents. A person who receives an alert still needs to contact the Superior Court Clerk or use the proper record access channel to obtain the filed document.

The Gwinnett FANS page describes the property filing notification tool.
